General Terms & Conditions of Sale

1. General conditions

This site is owned by Orologi Calamai – Via Fontanelle 21, 50014 Fiesole, Florence, Italy, tax code CLMFNC51P19D612U, VAT number 06229700486 – and is dedicated to online sales. Orologi Calamai adheres to the law on distance selling (Legislative Decree 185/99) that concerns precise duties for the seller and an equal number of rights for the customer. You are thus invited to carefully read the terms and conditions below and to conserve them in case of purchases from the “Orologi Calamai shop”.

Electronic commerce via the Internet is governed in Italy by the regulations on distance selling. The law (Legislative Decree no. 185 of 22/05/1999) guarantees the right to withdraw from the purchase contract for any reason within 10 working days from the date of receipt of the goods, without penalty and without explanation.

2. Prices and VAT

This article is addressed to the end user, to the “Customer”, thus to any physical person or company who operates on www.orologicalamai.it with aims not related to any commercial, entrepreneurial or professional activity (B2C). The selling prices of the products indicated on the site are expressed in euro. The prices shown are inclusive of VAT, although it is possible that some customers located outside the European Union are able to view prices with VAT excluded.

Sales destined for outside of the EU area (in the regions of: Africa – Central America – South America – Asia – Russia – Armenia – Azerbaijan – Belarus – Georgia – Moldova – Kazakhstan – Kyrgyzstan – Latvia – Turkmenistan – Tajikistan – Ukraine – Uzbekistan) are made free from VAT or other taxes. In this case, the Customer agrees to assume the full and exclusive responsibility for any customs duties, value added tax, excise or expenses of any other nature due and required in the Country of destination, also in relation to the possible exercise of the right of withdrawal.

3. Means of purchasing and accepting the order

To proceed with the purchase:

– select the product by clicking on the image, which provides access to the relevant description;

– click on BUY NOW and access the CART page;

– from here, decide whether or not to continue browsing or proceed with the purchase procedure;

– click on PROCEED TO PAYMENT;

– register or LOGIN;

– confirm the delivery address, telephone number, preference for delivery time, then select the delivery and payment methods;

– await confirmation of the transaction.

4. Terms of delivery

Orders will be shipped within 3-5 (three-five) working days, sent to the address indicated by the Customer by means of the agreed courier (unless otherwise communicated by Orologi Calamai upon receipt of the order). Delivery is normally effectuated within 5 working days from shipment in EU countries and within 10 working days from shipment in non-EU countries.

Each consignment includes an envelope containing the transport document and the invoice (at the Customer’s request).

The products shipped are contained in cardboard boxes of various sizes and sealed with personalised adhesive tape. Upon receipt of the order, the Customer is required to verify the conformity of the product delivered to them, being:

– that the number of packages indicated on the courier document is equal to the number of packages actually delivered;

– that all packages are received intact, undamaged and not wet, in compliance with the specifications described above.

After such verification, the Customer will sign and thus accept the Delivery Notice. No objection, in relation to the external characteristics of the package/s delivered, shall be accepted once the Delivery Notice has been verified and signed.

If, however, there is a discrepancy between the order and the delivery, in accordance with the methods outlined above, the Customer should not accept the goods and is required to raise the claim directly with the Carrier.

Should Orologi Calamai not be able to deliver the ordered goods as a result of a sudden or even temporary unavailability of the product, Orologi Calamai will promptly notify the Customer by email and in any case no later than 30 (thirty) days. The amount already paid by the Customer will be reimbursed as soon as possible and no later than 30 (thirty) days from the communication via email.

In no case can shipments be made to post office boxes, mail collection sites, mail boxes and the like. Furthermore, Orologi Calamai does not ship to countries and locations where, at its sole discretion, the minimum safety conditions necessary for transit and delivery of goods are not guaranteed.

5. Right of withdrawal

The rights of the Customer are protected by Legislative Decree no. 185/99, which regulates contracts concluded via distance selling. The Customer therefore has the right to withdraw from the contract, without explanation and at no cost, provided that the following procedures are respected:

– The withdrawal must be communicated via email to orologicalamai@gmail.com within 10 working days (please see the general conditions) from the day of receiving the products. Such communication must specify the order number, the wish to withdraw from the purchase of the product/s for which the Customer intends to exercise the right of withdrawal, as well as include a copy of the transport document.

The Customer must then return, at their own expense, the unused and undamaged product, complete with its original packaging, warranty and relative documentation, sending it to the following address: Orologi Calamai, Via Fontanelle 21, 50014 Fiesole, Florence, Italy, telephone +39 055 599726.

Orologi Calamai will not be responsible for the reimbursement or compensation of any products that are contested and returned only to be lost, stolen or damaged.

If the withdrawal has been exercised in accordance with the methods described, Orologi Calamai will refund the amount paid for the purchase as soon as possible, after the receipt of the returned goods and in any case within 30 days from the date on which Orologi Calamai became aware of the exercise of the right of withdrawal by the Customer. This is provided that Orologi Calamai has, in the meantime, received the goods and checked the integrity of the same.

6. Cancellation and/or modification of the order

In addition to the provisions of paragraph 5, the Customer can cancel the entire order or change its contents within and not later than 12 hours after placing the order. To change or cancel the order, an email must be sent via orologicalamai@gmail.com , to the attention of “Orologi Calamai Customer Service” and indicating the order number. Orologi Calamai Customer Service will contact the Customer as soon as possible, communicating the feasibility of the requested change.

7. Price variations

The products offered may vary in price.

When placing an order, the purchase price will be that shown, without considering any variations that may have subsequently been applied.

Orologi Calamai constantly verifies that all the individual prices indicated on its website are correct however, in the event that despite this, an error is determined in the price of the product, Orologi Calamai assumes full responsibility and shall offer the Customer the opportunity to reconfirm the purchase of the product at the correct price or to cancel the order. Only the price calculated at the time of the order will be applied to the Customer’s order, without any consideration of price increases or decreases that may have occurred in the meantime. Orologi Calamai constantly checks that all prices shown on the website are correct, however cannot guarantee the absence of errors. In the event that an error is determined in the price of a product, Orologi Calamai will offer the customer the opportunity to reconfirm the purchase of products at the correct price or to cancel the order altogether.

8. Payment

Payment of the order can be made via Credit Card (using PayPal via orologicalamai@gmail.com) or by bank transfer. In the case whereby bank transfer is chosen, the terms for fulfilling the order will commence from the accreditation of the same.

Orologi Calamai is not responsible for any fraudulent or illicit use of credit cards by third parties that may occur upon the payment of products purchased. At no time during the purchase process does Orologi Calamai become aware of the buyer’s credit card number, it being transmitted via a secure and direct connection between the Customer and the credit institution.

9. Responsibility

Orologi Calamai constantly updates the information on its Site which, however, may contain typing errors, inaccuracies or omissions, for which we hereby apologise. Orologi Calamai reserves the right to change or update information at any time without prior notice.

Orologi Calamai guarantees compliance with the quality standards related to its products. The company assumes no responsibility for disservices due to force majeure, such as accidents, thefts, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that may impede, in whole and/or in part, the processing of orders within the times outlined above.

Orologi Calamai declines any liability for direct or indirect damages of any kind or under any form whatsoever, resulting from the use of this website and/or news, photographs and information contained therein. Orologi Calamai will not be liable to any party for damages, losses or costs incurred as a result of failure to execute the contract due to the aforementioned causes.

10. Warranties

Orologi Calamai guarantees the authenticity of all products purchased on its Site. Each product is accompanied by a warranty with an international validity of 24 months from the date of purchase, according to the conditions specified in the same. The warranty is personal and will therefore apply only to the original purchaser.

11. Obligations of the purchaser

The Customer undertakes, upon concluding the online purchase procedure, to print and preserve these present General Terms and Conditions of Sale, as well as the specifications of the product subject to the purchase, in order to fully satisfy the conditions set out in Articles 3 and 4 of Legislative Decree no. 185/1999.

It is strictly forbidden for the purchaser to enter false data and/or third parties in the registration procedure necessary for activating the process for executing the remote contract and further communications. Orologi Calamai will prosecute any violation and abuse, in the interest and for the protection of all Customers.

12. Resolution of contract and express termination clause

Orologi Calamai reserves the right to withdraw from the contract (order) via simply informing the Customer; in this case, the Customer will be entitled only to the refund of any sum already paid, without any other indemnity.

The obligations assumed by the purchaser (please refer to the “Obligations of the purchaser”), as well as the guarantee of the successful payment of the sums due from the Customer in the manner laid out under the “Payment” item, are essential; therefore, any default by the Customer of even one of these obligations will result in the resolution of the right of the contract ex Article 1456 of the Italian Civil Code, sans any need for a judicial ruling, without prejudice to Orologi Calamai’s right to take legal action for compensation for any damages suffered.

13. Privacy

Pursuant to Articles 11 and 20 of Law no. 675 of 31st December 1996, the Customer expressly grants consent to Orologi Calamai – with registered office in Via Fontanelle 21, 50014, Fiesole, Florence, Italy – regarding collection, use, communication and/or dissemination of personal data, as outlined upon the compilation of all modules online and necessary for completing their purchases, along with that indicated on the Return/Withdrawal form, for purposes strictly connected and instrumental to the management of relationships with the compiler (internal statistics, feedback, preliminary acquisitions of information aimed at the conclusion of a contract or the provision of a service, and so forth) and for the purposes related to the obligations established by applicable laws.

The Customer also declares to be aware that, if expressly authorised by them in the registration phase, the data provided will be included in the “Orologi Calamai Customer Database” and may be used for promotional purposes or for sending editorial material.

The interested party expressly enjoys the rights referred to in Article 13 of Law 675/1996, namely:

  • to request confirmation of the existence of personal data at the Orologi Calamai office;
  • to know their origin, logic and purposes of their handling; to obtain any update, correction and integration;
  • to request cancellation, transformation into anonymous form or blocking in the case of unlawful processing;
  • to oppose its processing for legitimate reasons or in the case of use of data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication, provided that the achievement of the cancellation of their personal data is subject to sending a written communication directed to the company headquarters.

14. Security of transactions

The Electronic Commerce software used by Orologi Calamai takes into consideration the best techniques of encrypting information according to the SSL (Secure Socket Layer) protocol, thus all personal information and credit card data is sent via the Internet without any prying eyes being able to see the details.

The Customer can avail of a SSL Secure Server in a completely transparent way, by utilising any of the latest versions of Safari, Netscape, Internet Explorer or Firefox. These browsers are able to dialogue with the Secure Server in encrypted form, transmitting your information to the banking circuit (also in encrypted form) for verification.

During the sending and receiving of data in connection with a SSL Secure Server, masks are displayed that signal entry into secure areas and with the address of the page characterised by the prefix: https. Orologi Calamai uses the Secure Server SSL for the transmission of data related to credit cards. In practice, after selecting the payment by credit card, a page is accessed that permits the insertion of data and the subsequent sending of the same to the SSL Secure Server. Access to the SSL Secure Server takes place only when the data is actually sent. Transactions are carried out under reasonable conditions of security, with all data transmitted according to the SSL (Secure Socket Layer) security system. The use of this technology allows confidential information to travel on the Internet in an encrypted form only, being codified according to a complex mathematical algorithm that guarantees the confidentiality of communications and the inaccessibility of the data transmitted.

Orologi Calamai is not responsible for any errors, inaccuracies and/or malfunctioning of the security system.

15. Jurisdiction

Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated online through the e-commerce site www.orologicalamai.it is subject to Italian laws and jurisdiction.

These General Terms and Conditions of Sale are drawn up, to the extent not expressly provided for therein, pursuant to the combined provisions of Legislative Decree no. 50 of 15th January 1992 and Legislative Decree no. 185 of 22nd May 1999.

Any dispute between the parties regarding this contract will be fall under the exclusive jurisdiction of the Court of Florence, Italy.
